City Reapportionment - Legal Problems?
This is what the Charter says about appointment of reapportionment commission members . . . .

§ 18-12. Appointment.

In January of the year following each decennial census, the city clerk shall solicit nominations from citizens and community organizations of persons to be considered for appointment to the commission. The mayor and the president of the council shall not be required to appoint persons so nominated.

Prior to the end of February in the year following the decennial census, the president of the council with the approval of the council shall appoint five members of the commission and the mayor shall appoint four members. The chairman of the commission shall be elected by the members of the commission from the membership.

The 9 nominees were sent to the council at 4 PM on Friday, March 1, 2002. That looks like a problem to us.

1. "January of the year following each decennial census" would be Jan. 2001 . . .NOT 2002.
2. "Prior to the end of February in the year following the decennial census", again should be Feb 2001, not 2002.
3. "president of the council with the approval of the council shall appoint five members of the commission". There was no such approval by the Council of:

Since Pitts is vehemently against downsizing the council, especially his nearly $1/2 million / year office, does this group represent the diversity of citizen oponion, or the status quo?
